In these terms and conditions the following definitions apply:
Trader: Daalder Concepts B.V., trading as Hilox Lighting, which offers products at a distance to consumers.
Consumer: the natural person who is not acting in the course of a profession or business and enters into a distance contract with the trader.
Distance contract: a contract that, up to and including its conclusion, is concluded exclusively through one or more means of distance communication, such as this webshop.
Cooling-off period: the period within which the consumer can exercise their right of withdrawal.
Right of withdrawal: the consumer's option to withdraw from the distance contract within the cooling-off period.
Day: calendar day.
Durable medium: any means that enables the consumer or trader to store information addressed personally to them in a way that allows it to be consulted later unchanged.

Article 3. Applicability
1. These general terms and conditions apply to every offer by the trader and to every distance contract concluded between trader and consumer.
2. Before the distance contract is concluded, the trader makes the text of these terms available electronically, in such a way that the consumer can easily store them on a durable medium. On request we will send them free of charge.
3. If specific product or service terms apply in addition to these terms, in the event of conflict the consumer can always rely on the provision that is most favourable to them.
Article 4. The offer
1. If an offer has a limited period of validity or is subject to conditions, this is stated explicitly in the offer.
2. The offer contains a complete and accurate description of the products offered, detailed enough to allow a proper assessment. Images are a truthful representation. Obvious mistakes or errors in the offer do not bind the trader.
3. Every offer makes clear what your rights and obligations are, in particular: the price including VAT, any shipping costs, how the contract is concluded, whether the right of withdrawal applies, the method of payment and delivery, and the other legally required information.
Article 5. The contract
1. The contract is concluded at the moment the consumer accepts the offer and meets the conditions set in it.
2. If you accept the offer electronically, we confirm receipt immediately by email. As long as that confirmation has not been sent, you can dissolve the contract.
3. We take appropriate technical and organisational measures to secure the electronic transfer of data and ensure a secure web environment.
4. Within the legal framework we may check whether the consumer can meet their payment obligations. If we have good grounds for doing so, we may refuse an order with reasons or attach special conditions to it.
5. At the latest on delivery you receive, in writing or on a durable medium: the address for complaints, the conditions and procedure for the right of withdrawal, information about warranties and service, and the information from article 4, paragraph 3.
Article 6. Right of withdrawal
1. When purchasing products you can dissolve the contract without giving reasons during 14 days. This cooling-off period starts on the day after you, or a person you have named, received the product.
2. During the cooling-off period you handle the product and packaging with care. You only unpack or use the product to the extent necessary to establish its nature, characteristics and operation. A bulb that has already been fitted in a headlight and used generally falls outside this.
3. If you exercise your right of withdrawal, you notify us within the cooling-off period via the contact form on our contact page. After that you send the product back within 14 days, with all supplied accessories and, where possible, in the original condition and packaging.
4. You are liable for any reduction in value of the product if it results from handling of the product that goes beyond what is permitted in paragraph 2.
How returns work exactly, you can read on our Returns and right of withdrawal page.
Article 7. Costs on withdrawal
1. If you exercise your right of withdrawal, at most the direct costs of returning the product are for your account.
2. If you have already paid, we refund the purchase amount including the standard shipping costs of the outbound delivery as soon as possible, and at the latest within 14 days of your withdrawal. We may wait with the refund until we have received the product or until you demonstrate that you have sent it back.
3. We refund via the same payment method you used, unless you agree to a different method. This is free of charge.
Article 8. Exclusion of the right of withdrawal
The right of withdrawal can only be excluded if we state this clearly and in good time before the contract is concluded in the offer, and only for products:
1. made or put together according to the consumer's specifications;
2. that are clearly personal in nature;
3. that by their nature cannot be returned;
4. that can spoil or age quickly;
5. that after delivery are by their nature inseparably mixed with other products;
6. whose seal has been broken after delivery for reasons of health protection or hygiene.
Article 9. The price
1. During the period of validity of the offer we do not raise prices, except for changes in VAT rates.
2. Price increases within 3 months of the conclusion of the contract are only permitted if they result from statutory regulations or provisions.
3. Price increases from 3 months after the conclusion of the contract are only permitted if we have stipulated this and they result from statutory regulations, or if you can cancel the contract as of the day on which the increase takes effect.
4. All prices in the webshop include VAT.
Article 10. Conformity and warranty
1. We guarantee that the products comply with the contract, with the specifications in the offer, with reasonable requirements of soundness and usability and with the statutory provisions applicable on the date of the contract.
2. An additional warranty from us, the manufacturer or the importer does not affect the rights and claims you have under the law and the contract, such as the statutory warranty for a defect.
3. Lighting for vehicles must be fitted according to the instructions. Defects arising from incorrect fitting, modifications to the product or use outside the specifications are not covered by the warranty.
4. Whether a product may be used on public roads depends on the product, the vehicle and the rules that apply. The product page states what a product is intended for; if in doubt, we are happy to advise you beforehand.
Article 11. Delivery and performance
1. We observe the greatest possible care in receiving and carrying out orders.
2. The place of delivery is the address you have given us.
3. We carry out accepted orders with due speed, within 30 days at the latest, unless a different delivery period has been agreed. If that is not possible, you will hear this no later than 30 days after your order. You then have the right to dissolve the contract free of charge.
4. On dissolution under the previous paragraph we refund the amount paid as soon as possible, and at the latest within 14 days of dissolution.
5. The risk of damage or loss lies with us until the moment of delivery to you or a person you have named, unless expressly agreed otherwise.
Article 12. Payment
1. You pay via one of the payment methods offered at checkout. We process your order as soon as the payment has been received.
2. In sales to consumers we never stipulate an advance payment of more than 50%, unless you yourself choose at checkout to pay the full amount immediately.
3. You report any inaccuracies in payment details provided or stated to us immediately.
4. If payment is not made on time, we may, after a payment reminder with a period of 14 days, charge the statutory permitted collection costs.
Article 13. Complaints procedure
1. You report complaints about the performance of the contract within a reasonable time after you have discovered the defect, fully and clearly described, via the contact form on our contact page.
2. We answer complaints within 14 days of receipt. If a complaint needs more time, you will receive within 14 days an acknowledgement of receipt with an indication of when you can expect a more detailed answer.
3. If we cannot resolve it together, you can submit the dispute to the competent court. You can also use the European ODR platform for online disputes: ec.europa.eu/consumers/odr.
Article 14. Intellectual property
All intellectual property rights in the texts, images, videos and other content of this webshop belong to Daalder Concepts B.V., its suppliers or other rights holders. You may not copy them without permission.
Article 15. Personal data
We process your personal data exclusively in accordance with our privacy policy and the applicable privacy legislation (GDPR). In the privacy policy you can read which data we process, why, and what rights you have.
Article 16. Applicable law
Only Dutch law applies to all offers and contracts of Hilox Lighting and their performance. The Vienna Sales Convention is excluded. Mandatory consumer protection from the country where you live remains fully applicable.
Article 17. Additional or deviating provisions
Additional provisions or provisions deviating from these terms may not be to the consumer's disadvantage and are recorded in writing, or in such a way that the consumer can store them accessibly on a durable medium.
